Website Agreement
In short: your website is $79 a month, charged to your card. For a 3, 4 or 5 year term we waive the design and setup fees, and your rate stays at $79 for the whole term. If you leave early you pay back only the unused share of the waived fees. If a payment is missed your site stays up for 30 days, then goes offline (never deleted) until the balance is paid. When the term ends your plan moves to Care at $39 a month, which you can cancel any time.
1. Who this agreement is between
This agreement is between Think Web Pros ("we", "us") and the business or person placing the order ("you"). It covers the website plan, add-ons and services listed on your order.
2. Your plan and your locked rate
Your website plan is $79 per month. That rate is locked for your whole term: we will not raise it before the term ends. Monthly add-ons you choose (for example an online store or booking) are billed at the prices shown on your order. If we ever change an add-on's price, we will tell you at least 30 days ahead and you can remove that add-on without any fee.
3. Your term and the waived fees
Your term is set by how much work your site takes to set up:
| Plan | Term | Fees we waive |
|---|---|---|
| Basic: up to 5 pages from our templates | 3 years (36 months) | Design $499 + setup $149 = $648 |
| Standard: up to 10 pages, booking or a menu, content written or arranged for you | 4 years (48 months) | Design $999 + setup $199 = $1,198 |
| Plus: up to 15 pages, a store up to 50 products, or custom layouts | 5 years (60 months) | Design $1,499 + setup $249 = $1,748 |
The term starts on the day your first payment goes through. If you'd rather not sign a term, you can pay the design and setup fees up front and keep the plan month to month at $79, with no early exit fee.
4. Card billing
A contract plan needs a valid credit or debit card on file. By accepting this agreement you authorize us, through our payment processor Stripe, to charge that card each month for your plan and add-ons until the plan ends. You can update your card at any time from the link in any billing email. We never see or store your full card number.
5. Missed payments
- If a monthly charge fails, your site stays online for 30 days (the grace period). Stripe tries the card again during that time, and we email you reminders with a link to pay or update your card.
- If the balance is still unpaid after 30 days, your site is taken offline. Visitors see a "temporarily unavailable" page.
- Nothing is deleted. Your design, photos, domain, products and orders are all kept.
- As soon as the overdue balance is paid, your site goes back online on its own.
- An unpaid balance is still owed, and your term keeps running while your site is offline.
6. Ending your term early
You can end your plan before the term is over by telling us in writing (replying to any of our emails is fine). The early exit fee is the unused share of the fees we waived:
Early exit fee = waived fees × months left in the term ÷ months in the term
For example, leaving a Basic site after 12 months: $648 × 24 ÷ 36 = $432. Leaving a Standard site after 24 months: $1,198 × 24 ÷ 48 = $599. There is no fee once the term is over. The fee is charged to your card on file, and your plan stops once it is paid. After that we help you move your domain to you and send you a copy of your site's text and photos.
If we end the agreement because we can no longer provide the service, or because we broke it, there is no early exit fee.
7. After your term: the Care plan
We email you 30 days before your term ends. When it ends, your plan moves automatically to the Care plan at $39 per month, month to month. Care keeps your site hosted, renews your domain, and covers SSL, security updates, backups, uptime monitoring and up to 15 minutes of small edits a month. You can cancel Care at any time with no fee, effective at the end of that month. You can also sign a new term at $79 a month instead, which comes with a free site refresh.
8. What's included
- Hosting, an SSL certificate, firewall and bot protection, daily backups and uptime monitoring.
- One domain (.com, .net or .org) registered in your name and renewed each year while you have a plan.
- Up to 25,000 visits and 50 GB of bandwidth a month, and 5 GB of storage for photos and files.
- Up to 30 minutes of small edits by our team each month (text, photos, hours, prices). Unused time doesn't carry over. Bigger jobs are quoted first, at $60 an hour.
- No surprise charges: if your site goes over its allowance two months in a row, we'll offer a Traffic boost ($19/month for 50,000 more visits, 100 GB more bandwidth and 10 GB more storage). We won't add it without your OK.
9. Your domain and your content
Your domain is registered in your name and belongs to you. The text, logos, photos and products you give us stay yours, and you confirm you have the right to use them. You give us permission to host and show them on your site. Once your account is settled, we will help transfer your domain to any registrar you choose.
10. Acceptable use
Your site can't be used for anything illegal, for spam, malware or phishing, or to infringe someone else's rights. We may take a site offline that does, and we'll tell you why.
11. Limits
We work to keep your site online and secure, but we can't promise it will never be down. We are not responsible for indirect losses such as lost profits. Our total responsibility under this agreement is limited to the amount you paid us in the 12 months before the claim.
12. Changes and contact
We won't change your locked rate, term or early exit terms during your term. If we update other parts of this agreement, we'll email you at least 30 days before the change takes effect. Questions? Reply to any of our emails or write to us through thinkwebpros.com.
